ederal Government is to establish weigh-stations at the nation’s seaport to beat the new International Maritime Organisation, IMO, law that makes it compulsory for all consignment meant for export to be weighed before leaving their port of origin.
The law is expected to take effect from the 1st of July, 2016. A senior staff in the ministry of transportation, who disclosed this to Vanguard in Abuja on condition of anonymity, said that government is considering whether to construct the weigh-stations directly before concessioning them or construct them on a Public-Private Partnership basis. The ministry top shot told Vanguard that they are expecting a recommendation to that effect from the Nigerian Shippers Council, NSC, at the end of the just concluded workshop themed, “Transport cost and regional connectivity of African countries.” An official of the NSC who confirmed this to Vanguard explained that he could not speak officially on the issue as they have not sent their recommendation to the ministry but assured that they will work at beating the deadline for the implantation of the new policy. The NSC official said that they also considered the option of allowing terminal operators to handle the weighing of such consignments but reasoned that the terminal operators may use it as a means of further exploiting Nigerian shippers. Stakeholders at the Abuja workshop had kicked against the 1st July, 2016 commencement date because most countries in the sub-region except Ghana are not ready. They were however reminded by the Chris Welsh, Secretary General of Global Shippers Forum, GSF, the resource person that the new law was passed by the IMO in 2014. Walsh said member countries had the opportunity to contest the implementation last year before the agreed implementation date this year. He explained that mis-declaration of container weight has led to significant losses to shippers and shipping lines. According to him, the shipper is responsible for obtaining and documenting, the verified gross mass of the packed container, the verified gross mass must be communicated to the ship’s master or the shipping line terminal representative prior to loading of the ship, the communication should be signed by a duly authorised representative of the shipper (maybe an electronic signature.) He also stated that packed containers will not be loaded on ships unless the verified mass is provided to the master (in practice the shipping line or the line’s agent).

Tuns Farms: Court of Appeal strikes out Skye Bank’s case
The Court of Appeal sitting in Akure, the Ondo State capital, has struck out the motion of stay of execution applied by Skye Bank Plc on the judgement in favour of Tuns Farms Limited. The court said it took the position on the grounds that it lacks the jurisdiction to entertain the matter given that the bank had already filed an appeal challenging its ruling on the original case at the Supreme Court. In the same ruling the court also struck out all other motions sought by the bank. According to the presiding judge, Justice Sotonye Denton-West, the court was in agreement with Mr. Duro Adeyele (SAN), counsel to Tuns Farms Limited, that it lacks jurisdiction to entertain a case that has already been entered at the Supreme Court. She stated that any deliberation of the matter was “an exercise in futility” and “amounts to a waste of the court’s time”. She pointed out that the records of the case are already at the Supreme Court. Earlier, Mr. Oluwemimo Ogunde (SAN), counsel to Skye Bank, has persuaded the court to hear and rule on the motion that the execution of the original judgement by a trial court was not properly carried out and should be set aside, insisting that the court will have to rule one way or the other. In response, Justice Mohammed Ambi-Usi Danjuma, one of the judges of the Court of Appeal reminded the lawyer that “the supreme court will not be interested in asking whether or not the execution was properly done. The Supreme Court was approached to determine whether the Court of Appeal was right to uphold the judgement of the trial court.” Delivering the court’s ruling on the matter, Justice Denton-West said: “This court has been inundated by applications mostly overtaken by events and before the highest court of the land. If the rule of law is not respected, this will lead to anarchy. The court has no jurisdiction. A judgement has been executed. A motion of stay of execution will amount to academic exercise. There is no live issue to be determined by this court. The court is obligated to strike out the application and all other ancillaries. There are hereby struck out.” Osun State High Court Osogbo had, in three separate judgements against Skye Bank Plc, awarded damages totaling N3.9 billion to Tuns Farms Limited alongside other subsidiaries of Tuns Group. When the bank appealed the judgment at the Court of Appeal, the appellate court upheld the judgement of the trial court. Subsequently, Tuns applied to the High Court and got the writ of attachment and sale against goods of judgment debtor and the order was executed. According to Tuns in the writ of summon, the bank offered a credit facility of N414 million to it and the offer was accepted. The company said it had planned to use the fund to develop its property in Abuja. Tuns projected to earn a net income of N1.152bn from the project but the bank turned round and released only N150 million thereby breaching the contractual agreements entered with the company. Delivering his judgments at the high court on March 14, 2014, Justice A. O. Ogunlade said: “I am convinced by overwhelming evidence laid before me that the Defendant (Skye Bank) breached the fundamental terms of the contract in facility 11 of Exhibit PA1 without lawful justification and I hereby make an award of special damage in full to the Claimant, in the sum of N421,384,000, being the loss the Claimant suffered due to the refusal and failure of the Defendant to comply with the terms and conditions of the contract of 17th August, 2005. “The claimant through one of the paragraphs of its statement of claim has established the fact that the breach of the terms and conditions of the contract in facility 11 of Exhibit PA1 caused the Claimant’s director and shareholders myriad of psychological trauma and emotional breakdown.” Subsequently, Skye Bank appealed the judgement and lost again at the Court of Appeal. Adeyele told newsmen that the court awarded a total of N3, 991,150.000 to his client. According to the counsel, there was nothing inhibiting his client from executing the judgment. Skye Bank Plc, through its lawyers, has applied for a stay of execution of the judgment of the high court and following the execution also applied for the court to set aside the execution. Both applications were struck out by the Court of Appeal.

Dollar scarcity: Manufacturers turn to local raw materials
The scarcity of foreign exchange has forced some manufacturers to look inwards for raw materials, investigation has shown.
Manufacturers who spoke to our correspondent said they had embarked on urgent search for raw materials and substitutes that could be sourced locally because access to forex through the official route was near impossible while getting it through the black market was very expensive.
The fall in global oil prices has weakened the naira against the dollar while the Central Bank of Nigeria maintains an official exchange rate of N197 to a dollar.
The CBN later announced the closure of its official forex window, the Retail Dutch Auction System and Wholesale Dutch Auction System and followed the action by banning importers of 41 items from accessing forex at the official market, an action, which further caused the naira to plummet.
The bank had also in August 2015 barred banks from accepting cash deposits into domiciliary accounts as a measure aimed at preventing fraud and round tripping.
But in January 2016, the apex bank lifted the ban on lodgements into domiciliary accounts while announcing that it had stopped the sale of forex to over 2000 bureau de change operators nationwide.
The action by the CBN fuelled speculation, which caused one dollar to exchange for as high as N391 at the parallel market as of Thursday, February 18.
The dollar had further increased to N400 before the naira firmed up against it on Monday and Tuesday, February 21 and 22 to exchange for N371 and N310 respectively.
A master brewer of wines, Mr. Linus Kotey, said that his company had started doing everything to find local substitutes instead of waiting for foreign exchange.
According to Kotey, who is a biochemist and the Chief Executive Officer, PEL Extracts Limited, although the raw materials for wine are locally sourced, some of the packaging materials are imported.
“We are working hard to see if we can find locally sourced packaging materials or substitutes for the current packaging that we have,” he explained.
Also, Diageo, the parent company of Guinness, is targeting 70 per cent local raw materials by 2017, the Corporate Communications Manager, Guinness, Olayinka Edmond, told our correspondent.
According to her, the raw materials for one of the firm’s brands, Orijin Bitters, are 100 per cent locally sourced.
Similarly, an agro investor and exporter, Mr. Abiodun Oladapo, told our correspondent that the firm had in the past one month been substituting soya beans for its imported feed mill.
In the same vein, the Group Managing Director and Chief Executive Officer, Chemstar Paints Industries, Mr. Emmanuel Awode, said the firm was scouting around for local substitutes for its paint materials.
He said, “The dollar scarcity is particularly hard on the paint industry because over 70 per cent of our raw materials are imported, but we are looking around for local substitutes.”
The Chairman, BUA Group, Abdulsamad Rabiu, in a statement made available to our correspondent, said that in the last three years, the firm had gradually divested from business areas that were largely dependent on foreign exchange in favour of businesses whose raw materials could be sourced at least 90 per cent locally
He said, “We are fully concentrating on our core business including agriculture, mining and manufacturing that are less forex-dependent.”

Sergeant Amos Olaniyan (pictured right) who was verbally dismissed from
the Nigeria Police Force in 1994 over allegations of collecting bribe,
has been reinstated into the force after the senate intervened in his
matter. Olaniyan was verbally dismissed in 1994 on a baseless
allegation of bribery which an Orderly Room Trial discharged and
acquitted him of but the police refused to recall him..

Two students of Abia State University were butchered and beheaded in
front of Pego 1 lodge in the school yesterday by unknown people. There's
a speculation that this gruesome murder was done in retaliation to the
murder of a final year MBL student who was suspected to be a cultist
barely two weeks ago. No group has openly claimed responsibility
for the gruesome act. What is wrong with our young men of nowadays?

Lai Mohammed denies saying FG has lost control of the Nigerian economy
Over the weekend, there were reports that the Minister of Information
and Culture, Lai Mohammed, said that the Federal Government had lost
control of the Nigerian economy. The reports alleged that he said this
while fielding questions from a radio station in Abuja.
However, Lai Mohammed who was a guest on Channels TV this morning, said
the report is totally false.
